Public liability
Every occupier of land or buildings, whether it’s a home, shop, office, leisure club, park or factory, has a duty of care for visitors’ safety. Public liability is when someone hurts themselves because someone has neglected this duty. So, if you have suffered an injury due to this negligence of this duty then you could be entitled to compensation.
Most commonly, people make compensation claims against public liability through slipping or tripping in unsignposted areas. To be eligible to claim for compensation due to a slip or fall, then you must be able to show that the organisation responsible for maintaining the property has acted negligently through failing to inform its visitors of the danger of injury. For example, if you slip on some water on a floor in a supermarket, and there was no sign up to warn you of the potential danger of the wet floor, then you would be in a position to claim compensation. Furthermore, such incidents do not only occur in privately owned properties. if you are in a council-owned property, such as a school or park, then you can make a claim against the local authority.
Accidents while working or in a private home
If your accident happened whilst working, then you would claim against your employer ( see section for claiming whilst at work). Also, if you are injured in a private property, such as a house, then you may find that the owenrs may have insurance to cover your compensation claim.
