Q1: What can I claim for?

If you have been injured in an accident in the last three years that wasn't your fault then you may be able to claim compensation for the injuries which you have sustained and any reasonable consequential loss.

Q2: How much will it cost?

Claiming compensation can cost nothing at all. If you do not have the benefit of legal expense insurance then we can deal with your claim under a "no win -no fee/conditional fee agreement" which, when linked with an appropriate insurance policy arranged through our office means that your claim costs you nothing at all.

Q3: How long will it take to settle my claim?

This is really dependent upon the severity of the injuries sustained. However, claims for minor personal injuries should settle within a period of twelve months.

Q4: How long do I have to claim?

There is a statutory limit of three years from the date of the accident. A claim can be submitted at any stage during this period.

Q5: If I am involved in a hit and run accident or alternatively, an accident with an uninsured driver, does this mean I cannot make a claim?

No. A claim can be presented to the Motor Insurers Bureau who are an insurance backed body set up to deal with claims on behalf of untraced/ uninsured drivers.

Q6: If I have an accident at work and make a claim can I be sacked?

No, although if you have been with your employers for less than twelve months, you have few legal rights if you are sacked.

Q7: Do I have to pay anything out of my damages towards legal costs?

No. See answer to Q2 regarding "how much will it cost?" A conditional fee agreement can be entered into which will mean that Horwich Farrelly solicitors will not look to you for any monies on settlement of your claim.

Q8: Who will represent me?

Your claim will be dealt with by, or under the supervision of a qualified solicitor experienced in personal injury litigation.

Q9: Will I have to go to court?

It is unlikely that you will be required to attend court to have your case settled. Most cases are successfully negotiated without the need to attend a court hearing.

Q10: Will we take on your claim?

Your claim will be assessed as to its prospects. If we feel that reasonable prospects exist in pursuing a claim then the arrangements can be put in place in order that your claim can proceed.

Q11: What type of injury can I claim for?

You do not have to sustain a serious injury to be entitled to compensation. You are entitled, in law, to be compensated for any injury which you sustain which can include cuts, bruises and soft tissue injuries such as whiplash or strains.

Q12: How much will I get as compensation?

The value of each claim is determined by the medical evidence which is available detailing the injuries which have been sustained.

Q13: I have been involved in a car accident as a consequence of which, my own vehicle is off the road. Can I have a hire car?

You may be entitled to a courtesy vehicle either under the terms of your insurance policy or alternatively, with the repairing garage.

Q14: When will I get paid?

You will receive settlement monies on conclusion of your claim. However, we will endeavour to recover interim payments where possible on your behalf.
